Terms of Service

These terms cover your use of Nutcracker (heynutcracker.com), run by Border Zero Marketing Management L.L.C (“we”). By using Nutcracker you agree to them. Our Privacy Policy explains how we handle your data.

Access

Nutcracker is invite-only while in early access. Keep your sign-in secure; you are responsible for what happens under your account. Features, limits and availability may change while we build.

Paid plans

Paid plans renew each month until a team owner cancels. Our online reseller Fungies (fungies.io) sells them as merchant of record. It runs checkout, charges your card, adds sales tax or VAT, sends receipts and handles billing questions and refunds under its own buyer terms. Your work

What you put in and what Nutcracker makes for you is yours. You give us permission to store, process and send it to our providers only as needed to run Nutcracker for you and your team. Content you share by link can be seen by anyone with that link until you turn sharing off.

You confirm you have the rights and permissions needed for what you put in, including permission from anyone whose face, body or voice appears in it. If someone brings a claim against us over content you put in or published in breach of these terms, you cover our reasonable costs, to the extent the law allows.

AI output

Output is generated by AI models. It can be wrong, incomplete, or resemble existing work. Check it before you publish, especially facts, claims, and anything that uses names, brands or likenesses. You are responsible for how you use it.

Fair use

Do not use Nutcracker to:

• break the law or infringe anyone’s rights, including intellectual property and privacy;
• create content that is sexual involving minors, harassing, or meant to harm;
• make a real person’s face, body or voice without their permission;
• attack, overload, scrape, or reverse-engineer the service, or get around its limits;
• resell access without our written agreement.

Our Acceptable Use Policy has the details. We may suspend accounts that break it.

No warranty

Nutcracker is provided as is, during early access, without warranties of any kind. To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, data or business.

Ending

You can stop using Nutcracker at any time and ask us to delete your account. We may end access with notice, or without it for a serious breach of these terms.

Changes

If we change these terms, we update the date above and tell you about significant changes first.
